Welcome to DriveSpares (drivespares.lk), Sri Lanka's premier automotive spare parts classified marketplace. These Terms of Service govern your access to and use of our website, mobile interfaces, search engines, seller dashboards, and communication tools. By registering an account, browsing listings, contacting sellers, or publishing classified advertisements, you agree to be bound by these Terms.
1. Acceptance & Eligibility
By creating an account or accessing DriveSpares, you confirm that you are at least 18 years of age and possess the legal capacity to enter into binding agreements under the laws of the Democratic Socialist Republic of Sri Lanka. If you are registering on behalf of a registered auto business or spare parts dealership, you represent and warrant that you are authorized to bind that entity.
2. Nature of the Classifieds Marketplace
DriveSpares operates strictly as a specialized digital classifieds exchange connecting automotive parts buyers and independent sellers. DriveSpares is not an automotive parts reseller, manufacturer, distributor, auctioneer, or escrow provider. Contracts of sale, warranties, quality verifications, and delivery arrangements are entered into directly and solely between buyers and sellers.
3. Seller Obligations & Listing Authenticity
Sellers must provide accurate, non-misleading descriptions for all listed auto parts, including true condition (Brand New OEM, Genuine Used, Reconditioned, Aftermarket), exact OEM/Manufacturer Part Numbers, vehicle make/model compatibility, and clear photos of the actual item for sale. Misrepresenting stolen parts, counterfeit branded components, or non-functional items is strictly prohibited and subject to immediate account termination and reporting to law enforcement authorities.
4. Buyer Due Diligence & Part Verification
Buyers are strongly advised to inspect parts in person, verify OEM part numbers, test electronic sensors/ECUs before finalized payments, and exercise caution when ordering parts for courier delivery. DriveSpares does not guarantee that items meet individual technical expectations or manufacturer recall standards.
5. Prohibited Items & Zero Tolerance Policy
The following items and activities are strictly banned: counterfeit or illegally stamped parts, tampered odometer/meter units, stolen vehicle scrap components, weapons, illegal substances, and misleading pricing (such as fake Rs. 1 listings). Violations result in permanent hardware and phone number blacklisting.
6. Boost Promotions & B2B Subscriptions
Fees paid for classified Ad Boosts (7-day, 14-day, 30-day top placements), homepage banner promotions, and B2B Dealer Pro subscriptions are non-refundable once activated. Payment via online gateways or verified manual bank deposit slips must be confirmed by administrative moderators before promotion status is applied.
7. Intellectual Property & Trademark Notices
All DriveSpares brand logos, interfaces, software code, databases, and trademarks are the exclusive property of DriveSpares Classifieds (Pvt) Ltd. Vehicle manufacturer marks (such as Toyota, Honda, Nissan, BMW, Mercedes-Benz, Mitsubishi) and part brand names cited in listings are used solely for descriptive compatibility purposes under fair use.
8. Limitation of Liability & Dispute Disclaimer
To the maximum extent permitted by Sri Lankan law, DriveSpares and its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from transactions, vehicle mechanical failures, shipping delays, or disputes between buyers and sellers.
9. Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the substantive laws of Sri Lanka. Any legal action or proceeding arising out of or related to DriveSpares shall be instituted exclusively in the competent courts located in Colombo, Sri Lanka.
